1. Acceptance of terms
By accessing or using FaviconX (the "Service"), operated at https://www.faviconforge.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. Continued use after changes are posted constitutes acceptance of the updated Terms.
2. Description of the Service
FaviconX is a free web application that generates favicons from images or text. The Service is 100% client-side: your images are processed in your browser using the HTML5 Canvas API and are never uploaded to our servers. The Service is provided as-is and is intended for lawful, non-commercial and commercial use alike.
3. Your content
You retain all rights to the images you provide to the Service. Because processing is client-side, we do not store, copy, transmit or license your content. You are solely responsible for ensuring you have the right to use any image or brand you process with the Service, and you may use the generated favicons for any lawful purpose, including commercial websites.
4. Acceptable use
You agree not to use the Service to:
- Process content you do not have the legal right to use.
- Upload, distribute or generate content that is unlawful, infringing, defamatory or harmful.
- Attempt to probe, scan, exploit or disrupt the Service, its infrastructure or other users.
- Reverse engineer, decompile or scrape the Service beyond ordinary browser use.
- Misrepresent that generated output originates from you when such misrepresentation would mislead (brand impersonation).
5. Intellectual property
The Service's code, design, text, graphics and branding ("FaviconX") are owned by us or our licensors and are protected by applicable intellectual-property laws. The favicon files you generate from your own content belong to you. You may not copy, redistribute or resell the Service itself.
6. Third-party services and advertising
The Service may display advertisements served by third parties (such as Google AdSense) and may link to third-party websites (hosting providers, design tools, donation services). We are not responsible for third-party content, products or privacy practices. Interactions with third parties are governed by their own terms and policies.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated favicons will render identically across all browsers, devices and platforms.
Favicon rendering depends on the target platform's own behavior (caching, sizing and tile masking), which is outside our control. See the Disclaimer for details.
8. Limitation of liability
To the maximum extent permitted by law, FaviconX, its owners and contributors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from or related to your use of, or inability to use, the Service. Our total aggregate liability shall not exceed the amount you paid us to use the Service (which is zero, as the Service is free).
9. Indemnification
You agree to indemnify and hold harmless FaviconX and its owners from any claims, damages, liabilities and expenses arising from your use of the Service or your violation of these Terms or of any rights of a third party.
10. Termination
We may suspend or terminate access to the Service, in whole or in part, at any time without notice if we believe you have violated these Terms. You may stop using the Service at any time; no account exists to close.
11. Changes to the Service and Terms
We may modify, suspend or discontinue any part of the Service, or revise these Terms, at any time. When Terms change materially, we will update the "Last updated" date above and may notify users on the site. Continued use constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
